Welcome to Cosmetica Skin Plan. The terms "we", "us" and "our" refer to COSMETICA LIMITED, trading as Cosmetica London and Cosmetica Skin Plan. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide patients of our clinic with the skincare products recommended for them by their practitioner (the "Services"). Cosmetica Skin Plan is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights. Nothing in these Terms affects your statutory rights as a consumer.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (https://ee1ihu-vy.myshopify.com/policies/privacy-policy). If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
The Services are for patients of Cosmetica London. By agreeing to these Terms of Service, you confirm that you are 18 or over.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS AND YOUR SKIN PLAN
Products are offered to you because a practitioner at Cosmetica London has recommended them after an appointment. Your skin plan and the directions that come with it are personal to you. Please do not share your products or your plan with anyone else.
We have made every effort to show our products accurately. Colours and packaging may differ slightly from how they appear on your screen, and manufacturers may change packaging from time to time.
Skincare products are cosmetics unless we tell you otherwise. Use each product as directed in your plan and on its packaging. If your skin reacts, or you are unsure how to use a product, stop using it and contact the clinic. Information on this website is not a substitute for advice from your practitioner, and in an emergency you should contact the emergency services.
Prescription-only medicines are not sold, listed or paid for through this website. If your practitioner prescribes a medicine for you, it is supplied and paid for through the clinic. Your skin plan may include a note reminding you where a prescribed product fits in your routine.
Product descriptions and availability may change. We may discontinue a product or limit the quantity we supply. If a product in your plan becomes unavailable, we will contact you to suggest an alternative or refund you for that item.

SECTION 3 - ORDERS
When you pay for a skin plan or place a reorder, you are making an offer to purchase. Your order is accepted when we send you an order confirmation. We may decline an order, or part of an order, for example where a product is unavailable. If we decline or cancel an order or an item after you have paid, we will tell you by email and refund the amount paid for it.
Your rights to cancel, return or exchange a purchase are set out in our Refund Policy (https://ee1ihu-vy.myshopify.com/policies/refund-policy).
Products are supplied for your own personal use and not for resale.

SECTION 4 - PRICES AND BILLING
Prices are shown in pounds sterling and include VAT where it applies. The price charged will be the price shown at the time you place your order and will be set out in your order confirmation email. Delivery is charged in addition and is shown before you pay. Prices may change from time to time, but changes will not affect an order we have already accepted.
Prices on this website may differ from prices in the clinic or on other websites. We may offer promotions from time to time, which are governed by their own terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will apply.
You agree to provide current, complete and accurate payment and account information for all purchases, and to keep your email address and other account details up to date so that we can complete your orders and contact you as needed.
You confirm that the payment details you provide are correct and that you are authorised to use the payment method.

SECTION 5 - SHIPPING AND DELIVERY
We deliver to addresses in the United Kingdom only. UK delivery costs £5.95 per order. Most products arrive within 4 to 7 working days. If your plan includes products from more than one brand, they may arrive in separate parcels. Delivery times are estimates. If we are unable to deliver within 30 days of your order, you may cancel and receive a refund. The products are your responsibility from the time they are delivered to the address you gave us.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, video and audio, and the design, selection and arrangement thereof, are owned by us, our affiliates or licensors and are protected by copyright, trade mark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Cosmetica Skin Plan, Shopify or any third party. Unauthorised use of the Services may be a breach of intellectual property laws. All rights not expressly granted herein are reserved by Cosmetica Skin Plan.
Cosmetica Skin Plan's names, logos, product and service names, designs, and slogans are trademarks of Cosmetica Skin Plan or its affiliates or licensors. You must not use such trademarks without the prior written permission of Cosmetica Skin Plan. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Cosmetica Skin Plan is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Cosmetica Skin Plan. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cosmetica Skin Plan, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Cosmetica Skin Plan.

We may end this agreement or your access to the Services (or any part of them) if you seriously breach these Terms or misuse the Services. You will remain liable for any amounts due up to the date of termination, and we will fulfil or refund any order you have already paid for.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES
General information presented on or through the Services is provided for information only. It is not medical advice. The advice that applies to you is the advice given by your practitioner and the directions in your skin plan.
We will supply products with reasonable care and skill, and products will be as described, of satisfactory quality and fit for purpose, as the law requires. Beyond those legal duties, we do not promise that the website will be uninterrupted, secure or free from errors at all times, and we do not promise any particular result from using a product, since results vary from person to person.

SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products, or for any other liability that cannot be excluded or limited under the law of England and Wales.
Subject to that, we are responsible only for loss or damage that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for business losses, or for loss caused by products not being used in line with your plan, the directions supplied or the advice of your practitioner. Shopify and its affiliates are not liable to you in connection with your purchases from us.

SECTION 18 - INDEMNIFICATION
If you misuse the Services or break these Terms, you agree to compensate us for the reasonable losses and costs, including reasonable legal fees, that we incur as a direct result.

SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service are governed by the law of England and Wales. You and we agree that the courts of England and Wales will have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts there.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
